1. Role of POSP & Advisory Services
Policy Total operates strictly as a certified Point of Sales Person (POSP) under the regulatory framework of the Insurance Regulatory and Development Authority of India (IRDAI), attached to a Principal Entity (Broker/Corporate Agent).
We provide advisory services based strictly on the information and requirements shared by you, the customer. Please note that IRDAI is a regulatory body and does not offer advisory services to the public. While Policy Total acts as your intermediary to solicit pre-underwritten products, the ultimate choice and risk of the insurance product rest entirely with you.
2. Quotations, Underwriting & Right to Decline
Quotation Validity: All premium quotations provided on our platform or by our advisors are highly time-sensitive and are strictly valid only until 11:00 PM IST on the same day they are generated.
Underwriting Subjectivity: Final policy issuance and premium rates are subject to change. The insurance company (underwriter) reserves the absolute right to decline the vehicle, risk, or proposal after conducting their underwriting analysis, document verification, or physical/digital inspections.
Right to Service: Policy Total reserves the right to decline the processing of any policy, proposal, or service request at its sole, unquestionable discretion.
3. Premium Payments & Policy Issuance
No Extra Fees: Policy Total does not charge any extra hidden advisory or processing fees for policy issuance.
Premium Collection Prohibition: As a POSP, we are strictly prohibited from collecting premium amounts in cash or into our personal/business bank accounts. All premium payments must be made directly to the Insurance Company. Policy Total is not liable for funds transferred to unauthorized accounts.
Gateway Charges & Cheques: Any transaction charges or convenience fees levied by third-party payment gateways are to be borne entirely by the customer. If paying by cheque, the commencement of risk is strictly dependent upon the successful realization of the cheque by the insurer.
Issuance Delays: Policy Total relies on Insurer portals and shall not be held liable for financial losses, legal penalties (e.g., traffic challans), or claim rejections resulting from policy issuance delays caused by technical glitches, gateway failures, or pending underwriting approvals.
4. Claims, Endorsements & Cancellations
Claim Settlement: Policy Total acts solely as a facilitator during claims. We have absolutely no hand in the final claim settlement, approval, or rejection, which remains the exclusive legal domain of the insurance company's surveyors.
Post-Sale Changes: Requests for policy cancellations, refunds, or endorsements (e.g., changes in name, address, vehicle details) must be processed directly between the customer and the respective insurance company. We assist in routing these requests, but turnaround times are governed strictly by the Insurer.
5. Utmost Good Faith, KYC & Falsification
Insurance contracts are governed by the principle of Uberrimae Fidei (Utmost Good Faith). The customer is solely responsible for ensuring the accuracy of all KYC, AML, and vehicle documents (PAN, Aadhaar, RC, previous policy, NCB history) provided.
The falsification, concealment, or misrepresentation of any data will lead to immediate policy cancellation or claim repudiation by the insurer without any premium refund. Policy Total holds zero liability for policies rejected due to customer-provided discrepancies.
6. Promotional Offers & Tax Liability
Policy Total Giveaways: As part of our customer engagement, Policy Total runs independent monthly giveaways and gift programs. Winners are selected at our sole discretion. Gifts cannot be exchanged for cash, and eligibility requires the purchased policy to remain active and un-canceled.
Tax Liability: Any tax liabilities, Tax Deducted at Source (TDS) under Section 194R of the Income Tax Act, or statutory levies arising from winning a giveaway/gift are the sole responsibility of the winning customer.
Insurer Offers: Any separate promotional offers or value-added services run directly by the insurance provider must be claimed by the customer from the insurance company. Policy Total has no liability in fulfilling insurer-specific promotions.
7. Data Protection (DPDP 2023) & Communications
By utilizing our services, you explicitly consent that your data may be used by Policy Total for internal research, quality assurance, product improvement, and the cross-selling of related financial products.
Communications: Policy Total and its authorized advisors reserve the right to reach out to you via phone calls, SMS, WhatsApp, or email regarding policy renewals and administrative updates, overriding any NDNC (National Do Not Call) registry preferences for transactional purposes.
Data Security & Revocation: In compliance with the Digital Personal Data Protection (DPDP) Act, 2023, you retain the right to revoke consent for promotional communications. However, Policy Total shall not be held liable for any data breaches occurring on the Principal Entity's or Insurer's servers once your data has been securely transmitted for underwriting purposes.
8. Indemnification
The customer agrees to indemnify, defend, and hold harmless Policy Total, its founders, employees, and advisors from and against any claims, legal penalties, losses, damages, or legal costs arising out of the customer's falsification of documents, fraud, breach of Utmost Good Faith, or violation of these Terms and Conditions.
9. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Policy Total, its founders, and advisors shall under no circumstances be liable for any direct, indirect, incidental, punitive, or consequential damages. This includes, but is not limited to, rejected insurance claims, loss of profits, third-party liabilities, or delayed policy issuance arising out of your use of our advisory services.
10. Severability & Right to Amend
Severability: If any provision of these Terms is deemed unlawful, void, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Right to Amend: Policy Total reserves the right to amend, modify, or update these Terms and Conditions at any time without prior individual notice. Continued use of our services constitutes acceptance of the revised Terms.
11. Force Majeure & Governing Jurisdiction
Force Majeure: Policy Total shall not be held liable for any failure to perform its obligations due to events beyond its reasonable control, including natural disasters, internet outages, government restrictions, or pandemics.
Jurisdiction: Any disputes arising specifically from the advisory services provided by Policy Total shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal, India. Disputes regarding the insurance contract itself must be taken up with the respective Insurer or the Insurance Ombudsman.
